Shaanxi: Prohibit illegal crossing of Qinling core protection area and Taibai Mountain

According to the WeChat public account of Taibai Mountain Nature Reserve, on December 5, Taibai Mountain Nature Reserve issued a notice prohibiting “illegal crossing of Qinling core protection area and Taibai Mountain”, saying that Qinling is an important ecological security barrier in my country. In order to strengthen the protection of the ecological space of the ancestral Qinling Taibai Mountain, effectively rectify illegal acts such as destroying resources, polluting the environment, interfering with wild animals, causing forest fires, and causing casualties, illegal activities crossing the Qinling core protection area and Taibai Mountain National Nature Reserve are cracked down in accordance with the law.

According to the Forest Law of the People’s Republic of China, the Regulations of the People’s Republic of China on Nature Reserves, the Law of the People’s Republic of China on Public Security Administration Punishment, the Criminal Law of the People’s Republic of China, the Regulations of the People’s Republic of China on the Protection of Ecological Environment of Qinling Mountains in Shaanxi Province, and other laws and regulations, the notice is as follows:

I. Any unit, organization or individual is prohibited from entering the core protection area (within Taibai County) and Taibai Mountain National Nature Reserve area with an altitude of more than 2,000 meters above sea level in Qinling Mountains, within 1,000 meters on both sides of the main beam of the Qinling Mountains, and within 500 meters on both sides of the main branches, without authorization, and conduct illegal crossing activities.

2. Any unit, organization or individual is prohibited from providing transportation, accommodation, information and other services to those who illegally cross the Qinling Core Reserve and Taibai Mountain National Nature Reserve.

3. It is prohibited to illegally produce, print, publish and disseminate traditional media and online media information that cross the Qinling Core Reserve and Taibai Mountain National Nature Reserve.

4. Units, organizations or individuals that violate the provisions of the notice shall be punished in accordance with Article 23 and Article 49 of the “Public Security Administration Punishment Law of the People’s Republic of China”, Article 275 of the “Criminal Law of the People’s Republic of China”, Article 34 of the “Nature Reserve Regulations of the People’s Republic of China” and the “Shaanxi Qinling Ecological Environment Protection Regulations”; units, organizations and individuals that cause serious damage to the natural resources of the reserve, serious pollution of the ecological environment, forest fires, and casualties shall be punished in accordance with relevant laws and regulations. If their behavior constitutes a crime, they shall be punished in accordance with the provisions of the “Criminal Law of the People’s Republic of China”.

5. Anyone who illegally crosses the Qinling Core Reserve and Taibai Mountain National Nature Reserve and obstructs state agency staff from performing their duties in accordance with the law by insulting, besieging, setting up obstacles and other dangerous means shall be punished by the public security organs in accordance with Article 50 of the “Public Security Administration Punishment Law of the People’s Republic of China”; if his behavior constitutes a crime, he shall be punished in accordance with the provisions of the “Criminal Law of the People’s Republic of China”.

6. This notice shall take effect from April 1, 2024. The prohibited areas of the notice are the Qinling Core Reserve and Taibai Mountain Nature Reserve within Taibai County.
